1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the wireless network service (“Service”) operated within Platform94. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Service.
The Service is provided solely as a convenience to users and does not create any advisory, fiduciary, or professional relationship between you and Platform94. No responsibility, duty of care, or undertaking beyond what is expressly set out in these Terms is assumed by Platform94.
2. Eligibility and Scope
The Service is available to tenants of Platform94, their employees, contractors, invited guests, and other authorised individuals. These Terms apply to all persons who access or attempt to access the Service, regardless of whether they are using personally owned or corporately owned devices.
Where a user is an employee, contractor, or guest of a tenant organisation, that organisation is jointly and severally responsible for any breach of these Terms or unlawful activity arising from that user’s access to the Service.
3. Acceptable Use Policy (AUP)
You agree to use the Service in compliance with applicable Irish and EU law, including but not limited to cybercrime, intellectual property, terrorism, child protection, and data protection legislation.
You must not use the Service to access, download, store, distribute, or facilitate illegal content or unlawful material, including Child Sexual Abuse Material, extremist or terrorist content, incitement to hatred, or copyright-infringing material. You must not probe, hack, attack, or otherwise interfere with systems, devices, or networks, nor attempt to introduce malware, unauthorised access points, command-and-control tools, or crypto-mining software.
You must not use the Service in a manner that degrades performance for others, circumvents security controls, or involves the sharing of access credentials. If unlawful activity is detected or reasonably suspected, Platform94 reserves the right to report the matter, together with relevant log information, to An Garda Síochána, the National Cyber Security Centre, or any other competent authority.
Platform94 may monitor traffic metadata strictly for the purposes of network security, operational integrity, and compliance with law. Content inspection does not occur except where legally required.
4. Service Availability and Limitations
The Service is provided on an “as-is” and “as-available” basis. No warranty, guarantee, or representation is given as to coverage, reliability, performance, speed, or suitability for any purpose.
You acknowledge that the Service must not be relied upon for business-critical, safety-critical, medical, monitoring, or emergency use, and you accept full responsibility for any reliance placed on the Service.
Platform94 may restrict, suspend, modify, throttle, or terminate access at its discretion, including for maintenance, performance management, security reasons, or breach of these Terms.
5. Data Processing and Privacy
Personal data processed through the Service is handled in accordance with the EU General Data Protection Regulation and the Data Protection Act 2018.
Platform94 may collect network-related data including device identifiers, IP and MAC addresses, access point location, timestamps, session duration, bandwidth usage, and security event logs. The content of communications is not monitored except where required by law.
This information is processed for the purposes of network operation, troubleshooting, performance management, security monitoring, fraud prevention, enforcement of these Terms, and compliance with Irish and EU legal requirements.
Log information may be disclosed to law enforcement authorities, regulatory bodies, insurers, or legal advisors where necessary to comply with legal obligations or to defend legal claims.
Data will be retained only for as long as necessary for the purposes set out above. A full Privacy Policy is available from Platform94 management or via the Wi-Fi access page.
6. Security Disclaimer
The Service may be open or only lightly secured, and traffic transmitted over it may be unencrypted. You acknowledge that confidentiality of communications cannot be guaranteed.
You are solely responsible for securing your device and communications, including through the use of firewalls, encryption, operating-system updates, antivirus tools, and VPN software. Platform94 accepts no responsibility for unauthorised access to devices, interception of data, identity theft, or security incidents resulting from your use of the Service.
7. Liability
To the maximum extent permitted under Irish law, Platform94 disclaims all warranties, express or implied, relating to the Service, including non-interruption, security, connectivity, speed, or fitness for purpose. Platform94 is not liable for data loss, business interruption, system compromise, corruption, or any consequential or indirect damages arising from use of or reliance on the Service.
Nothing in these Terms limits liability where such limitation is prohibited by law.
8. Indemnity
You agree to indemnify and keep indemnified Platform94, its officers, directors, staff, and contractors against all losses, damages, penalties, liabilities, claims, legal fees, and costs arising from your use of the Service, including unlawful activity, breach of these Terms, or failure to secure your device.
Where the user is associated with a tenant organisation, that organisation accepts full financial and legal responsibility for the actions of its employees, contractors, and guests.
9. Fair Usage and Enforcement
You acknowledge that Platform94 may apply bandwidth limits, device blocking, access time controls, filtering, or traffic prioritisation to maintain service quality and protect network integrity. Platform94 may use automated systems to identify malicious or anomalous behaviour and may block affected devices without notice.
10. Suspension and Termination
Platform94 may immediately suspend or terminate access to the Service where it believes that a device or user presents a security risk, violates these Terms, engages in unlawful activity, or where required to do so by legal or regulatory authorities. Suspension may occur without notice and without prejudice to Platform94’s right to pursue legal remedies.
11. Changes to Terms
Platform94 may amend these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Ireland. Any disputes arising in connection with them are subject exclusively to the jurisdiction of the Irish courts.
